Police are continuing investigations into a complaint against an MP by his partner for alleged assault, despite her withdrawal of the complaint.
The special unit of Limassol CID that received the complaint last Sunday is collecting testimony around the case, even though the woman withdrew the complaint in writing yesterday morning for reasons she did not mention.
Beyond this development, the Law Office has given clear instructions for investigations to continue unhindered, and specific actions have been requested to substantiate the complaint.
In an attempt to strengthen the testimony the complainant gave, investigators may travel to Athens at some stage to obtain testimony and evidence from people who know about the incident with the help of Greek colleagues.
Investigators are also awaiting the report from forensic pathologist Angeliki Papetta, who examined the complainant forensically last Tuesday. Her findings will be sufficiently critical for the final outcome of the case.
These findings will be cross-checked with those recorded by a doctor in Athens who first examined MP Nikos Sykas’ partner after the alleged incident that allegedly occurred in a hotel room in the Greek capital.
The question now is what stance the MP himself will maintain after the complaint withdrawal during the examination of the Attorney General’s application for lifting his immunity by the Supreme Court.
He had expressed the position that he is at the disposal of the authorities to explain the ‘actual facts’, after rejecting his partner’s claims. However, after the complaint withdrawal, the circumstances have changed.
Either Sykas will consent through his lawyer to lifting his immunity and maintain a helpful stance in examining the complaint, or he can now, invoking the change of stance by the complainant, raise an objection to lifting immunity, essentially invoking the absence of a complaint.
He expressed disagreement in his party’s collective bodies not to be a candidate for the upcoming parliamentary elections, which shows his intentions.
All will be clarified on Monday, when the Attorney General’s request to lift immunity is scheduled for examination. The final decision on whether the case will reach justice or not will depend on the totality of the testimony and data.
As previously reported, several domestic violence cases are taken to court even though the victim withdraws the complaint for obvious reasons, with the outcome left to be decided after the victim is called to the stand to declare their final position.
